Hereinafter called the SEVENTH PARTY which term shall mean and

WHEREAS
the First, Second, Third, Fourth, Fifth, Sixth and Seventh parties herein are
the absolute joint owners and possessors of the agriculture land bearing Survey
No. ____________________, Acres______ Gts.______Situated

(Mandal) ____________________Districts, which was inherited / having
purchased the same from __________ through a sale deed / Gift /Gift Settlement
deed registered as No.______ of ________ of S.R.O. ____________________ copied
in Volume No. ____________________ at Page ____________.
WHEREAS the parties hereto have
agreed to partition the said property by metes and bounds in order to have
better enjoyment and effective control and dealings of their respective
separated portion with absolute authority thereof in the following manner:-
1. WHEREAS the First
Party has been allotted Schedule “A” Property (which is more fully described at
the foot of this Deed), and delineated in RED colour in the plan annexed to
this Deed.
2. WHEREAS the Second
Party has been allotted Schedule “B” Property (which is more fully described at
the foot of this Deed), and delineated in GREEN colour in the plan annexed to
this Deed.
3. WHEREAS the Third
Party has been allotted Schedule “C” Property (which is more fully described at
the foot of this Deed), and delineated in BLUE colour in the plan annexed to
this Deed.
4. WHEREAS the Fourth
Party has been allotted Schedule “D” Property (which is more fully described at
the foot of this Deed), and delineated in ORANGE colour in the plan annexed to
this Deed.
5. WHEREAS the Fifth
Party has been allotted Schedule “E” Property (which is more fully described at
the foot of this Deed), and delineated in PINK colour in the plan annexed to
this Deed.
6. WHEREAS the Sixth
Party has been allotted Schedule “F” Property (which is more fully described at
the foot of this Deed), and delineated in BROWN colour in the plan annexed to
this Deed.
7. WHEREAS the Seventh
Party has been allotted Schedule “G” Property (which is more fully described at
the foot of this Deed), and delineated in PARROT colour in the plan annexed to
this Deed.
NOW
THIS PARTITION DEED WITNESSETH AS FOLLOWS:-
1. That each of the
parties hereby releases and relinquishes all their rights in favour of the
portion allotted to the other parties and hereafter the Parties shall enjoy
their respective allotted portions respectively without any interference or
disturbance from the other parties or any other person claiming through or
under them.
2. Each of the parties
hereto declare that they have no right, title, interest of whatsoever nature in
respect of the properties so allotted to the other parties, since the parties
have conveyed by release and relinquishment of their respective right, title
and interest therein allotted to them respectively free and discharged from all
claims and demands of other thereto or concerning therewith.
3. That the partition
was effected by all the parties by their own accord and free consent
voluntarily without any coercion, fraud or undue influence as such the same is
binding on them, their heirs and persons claiming under them or through them.
The partition hereunder is fair, conclusive and total and is not open to
challenge at any time by any of the parties hereto or their heirs and cannot be
reopened under any circumstances.
4. The parties do
hereby covenant agree and declare that they had and still have good marketable
title, full power and absolute authority to have the said property partitioned
in the manner hereinbefore indicated and none of them have charged nor encumbered
the same or any part thereof nor otherwise dealt with nor done executed or
performed any act, deed or thing or suffered any thing to the contrary whereby
or by reason or means whereof the same may be effected or prejudiced in title
or they may be hindered or prevented from having the same granting, conveying
or having the same partitioned as effected by these presents.
5. That the parties
hereto shall be entitled to hold, possess and enjoy their respective allotted
portion absolutely without any claim or demand or interruption whatsoever of
any other party and they are entitled to sell, transfer by way of gift,
testamentary disposition or mortgage or convey or otherwise use or put to use
the said property fell to their respective share absolutely as absolute owner
thereof.
6. That the parties do
not have any claims and shall not lay any claims of whatsoever nature against
each other in future and all their respective claims and counter claims stand
fully settled and satisfied.
7. That the Parties herein
are already in possession of their respective allotted portions. That the
Municipal and Electricity charges shall be paid by the respective parties in
respect of their allotted portion separately.
8.
This Deed has been executed in
original with copies and the original
copy and original title deeds or link documents shall be kept by the _________7th
Party, and one copy each has been given to the other parties, the ______7th Party shall produce the original copy and
link documents etc. Whenever required by the other parties in future.
9.
The properties described in
_______to ________ schedulues are not assigned lands within the meaning of the
A.P.Assigned Lands (Prohibition of Transfers) Act 9 of 1977 as they do not
belong to or under mortgage to Govt. agencies / Undertakings.
